    “Trends and Future of Transfer Pricing Risk management”


    The proposed revision of the OECD Guidelines seem to suggest a convergence between regulations with day-to-day practices grown over the past decade, suggesting process-based approaches and offering a broader choice to companies in applying transfer pricing methods. On the other hand, the realisation breaks through that “mainstream”, compliance-driven approaches to TP may not give the necessary assurance. From reservations surfacing in the proposed revision of Chapters I – III, through concepts introduced in the OECD discussion draft on Business Restructurings, to the new imperatives behind the US cost sharing regulations, we can see the signs that force us to think about the question whether “mainstream” will be sufficient going forward.

    Tax authorities are developing their skills, are building up dedicated resources, and have set their goals given the structural need of countries to reduce their budget deficits. Recent case law in major jurisdictions seems to indicate that economic principles play a decisive role in developing and applying sustainable solutions in transfer pricing. Are these economics-based approaches the key to effective risk management in TP? How can we develop the solutions that enable CFOs to accept the responsibility for managing these risks?

    TEI has invited three independent firms – NERA, Transfer Pricing Associates and Baker & McKenzie - with a growing reputation in transfer pricing to give us their views and facilitate discussion among ourselves about the Trends and Future of Transfer Pricing Risk Management in the coming decade. Our keynote speaker on the Chapter Day is the Director of the UK Large Business Service, Freda Challoner, CBE. Registration egistration for this exciting TEI meeting is now open.

    The meeting will take place September 30th - October 1st 2010 and is to be held at Bechtel’s offices in Hammersmith, West London – only 30 minutes from Heathrow airport.

    The Chapter Day on Thursday September 30 will start with meetings of the active committees and all are invited to join these meetings. After lunch we will have a program including presentations from our president Clive Baxter, the traditional roundtables and the committee chairs. Our lunch sponsor will be Transfer Pricing International, the dedicated transfer pricing recruitment firm. Liz Tookey of TPI will make a presentation on recruitment of transfer pricing staff and career paths. As an interesting parallel track for our members Barrie Pallen of BPA will be available throughout the afternoon for individual consultations on recruitment and career development for tax professionals. Our keynote speaker will be Freda Challoner, CBE, Director of HMRC’s Large Business Service.

    In the evening a networking event and dinner will take place in London.

    The Education Day on October 1st will be organized by professionals from the three firms – NERA, TPA Global and Baker & McKenzie - with the main theme of “Trends and Future of Transfer Pricing Risk Management in the coming decade”
